Official Rules
ODDS OF WINNING DEPEND ON NUMBER OF ENTRIES RECEIVED. VOID WHERE PROHIBITED BY LAW.
1. Participation in the Super Bowl for Super Kids Promotion (the “Promotion”) constitutes particpant’s (and Entrant’s, as that term is defined below) full and unconditional agreement to these Official Rules (the “Official Rules”). The Sponsor is Boys & Girls Clubs of Southeast Louisiana, Inc. (the “Sponsor”), 650 Poydras St., Suite 1000, New Orleans, LA 70130, a Louisiana non-profit corporation. These Official Rules shall be governed by the laws of the State of Louisiana, ignoring its conflict of law rules. All decisions related to, as well as all interpretation of, these Official Rules by Sponsor will be final.
2. The Promotion is open only to legal residents of the fifty (50) United States (including District of Columbia) who are at least 18 years of age at the time of entry. Employees (including spouses and dependants) of Sponsor are not eligible. Eligibility for the Promotion is subject to compliance with these Official Rules.
3. The sole and exclusive method of entering the Promotion is as follows: The Promotion is a raffle in which Sponsor is selling (through “Sales,” as defined below) raffle tickets (each a “Raffle Ticket”; with each purchaser being an “Entrant”) for the price of $100.00 per Raffle Ticket; where each Raffle Ticket represents a chance to win the opportunity to accept an offer of the Prize (as that term is defined below) on the terms and conditions set forth herein. Raffle Tickets must be purchased from Sponsor no later than 10:30 a.m. January 30, 2010 (the “Deadline”). A maximum of 1,000 Raffle Tickets will be sold. Raffle Tickets are available on a first come, first serve basis. There is no limit to the number of Raffle Tickets an Entrant may purchase.
4. Sales may take place in any manner chosen by Sponsor, and may include without limitation, at Sponsor’s discretion, Sales on Sponsor’s internet website, Sales through Sponsor’s agents, and/or Sales at Sponsor’s corporate office located at 650 Poydras St., Suite 1000, New Orleans, LA 70130 during normal business hours, 9:00 am through 5:00 pm, Monday through Friday excluding holidays. Entrants who do not provide valid or current contact information for the Entrant will be disqualified. Sponsor reserves the right to modify the Promotion in the event of any fraud, technical failure or other factor beyond Sponsor’s reasonable control impairs Sponsor's ability to properly conduct the Promotion. No more than the stated number of prizes will be awarded for any reason, even if more prizes are claimed as a result of any error or erroneous notification that any participant is a winner. All Sales are final and non-refundable. Each Sale constitutes Entrant’s full agreement with all of the Official Rules.
5. The $100.00 price for each Raffle Ticket is not deductible for federal and state income tax purposes.
6. The potential winner (the “Potential Winner”) will be randomly selected from all eligible entries promptly after the Deadline, at an event (the “Drawing”) currently scheduled for January 30, 2010 at 11:00 a.m. at Sponsor’s NFL-YET Unit located at 1140 S. Broad St., New Orleans, LA 70125 (although Sponsor reserves the right to modify the place, time, and manner of the Drawing for any reason). The Potential Winner need not be present at the Drawing, but must present his or her winning Raffle Ticket and proof of identification to claim the Prize (as that term is defined below). If the Potential Winner is not eligible or cannot be reached by Sponsor within 24 hours of the Drawing, or fails to sign and return Sponsor’s Release and Affidavit of Eligibility (in which Potential Winner will confirm his or her eligibility and shall release Sponsor of all claims related to the Promotion) within 24 hours of notification, he or she will be disqualified. If the Potential Winner is disqualified for any reason, Sponsor will promptly select a new Potential Winner using random selection (subject to all provisions within this section (5)). A winner list may be obtained by printing the requestor’s name, address, city, state, and ZIP code on a 3” x 5” postcard and mailing it to Sponsor at the address listed above to the attention of: Office Manager; RE: Promotion Winner List.
7. One Prize (the “Prize”) will be awarded consisting of: two tickets to Super Bowl XLIV taking place on February 7, 2010 in Miami, Florida plus a $500 travel voucher.
8. TOTAL FACE VALUE OF THE PRIZE: $2,300.00. Prize winnings are fully taxable under Federal and State of Louisiana law. The winner will be issued IRS Form W-2G in this amount for tax year 2010. Federal and State of Louisiana income tax withholding in the amount of $762.23 is included as part of the prize (Federal - $680.56, State - $81.67). As required, the withholding tax will be remitted to the taxing authorities by Boys and Girls Club of Southeast Louisiana. Boys and Girls Club of Southeast Louisiana will NOT be responsible for any individual income taxes over the amount included in the prize.
The winner must complete form W-9 with a valid taxpayer identification number.
The winner will be required to sign a publicity release permitting Boys and Girls Club of Southeast Louisiana to use his or her name, photograph, likeness and voice for any promotional purposes in any media.
Boys and Girls Club of Southeast Louisiana is not responsible for any injuries, losses or damages of any kind arising in connection with or as a result of the winner’s acceptance or use of any prize.
The National Football League, its member professional football clubs, NFL Ventures, Inc., NFL Ventures, L.P., NFL Properties LLC, NFL Enterprises LLC and each of their respective subsidiaries, affiliates, shareholders, officers, directors, agents, representatives and employees (collectively, the “NFL Entities”) will have no liability or responsibility for any claim arising in connection with participation in this raffle or the prize awarded. The NFL Entities have not offered or sponsored this raffle in any way.
All federal, state and local laws and regulations apply.
Odds of winning a Prize depends on number of Raffle Tickets sold, but are estimated to be (based on an estimated 1,000 Raffle Tickets sold) 1:1000. The odds may vary depending on whether more or less Raffle Tickets are sold through Sales.
9. The winner of the Prize is subject to all applicable federal, state, and local taxes. The winner accepting the Prize will be subject to all applicable laws and regulations including any restrictions, which may apply to use of the Prize.
10. By participating, participants and Entrants agree that any disputes arising under these Official Rules shall be resolved individually, without resort to any form of class action, and exclusively by a court located in New Orleans, Louisiana.
11. Net proceeds from the sale of raffle tickets will be used to support the activities of the NFL Youth Education Town New Orleans Boys & Girls Club.
